Welcome to SellBig AI (“SellBig,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website at sellbig.ai and all related services (the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 16 years old and capable of forming a binding contract to use the Service. By creating an account, you represent that you meet these requirements.

2. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

3. Credits and Payments

Purchasing Credits

The Service operates on a credit-based system. You purchase credits through one-time payments processed by Stripe. Credit packages and pricing are displayed on our pricing page and may be updated from time to time.

Credit Usage

Each image generation job consumes credits as described at the time of purchase. Credits are non-transferable and are tied to your account. Credits do not expire.

Refunds

If you are unsatisfied with the quality of generated images, you may request a refund within 14 days of purchase by contacting us at support@sellbig.ai. Refund requests are evaluated on a case-by-case basis. We reserve the right to deny refund requests where credits have been substantially consumed or where we detect abuse.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or to generate illegal content
• Upload images that infringe on the intellectual property rights of others
• Upload images containing explicit, harmful, or offensive content
• Attempt to reverse-engineer, decompile, or extract the AI models or algorithms
• Use automated scripts, bots, or scrapers to access the Service
• Circumvent rate limits, credit systems, or other technical restrictions
• Resell access to the Service or generated images as a competing service

5. Intellectual Property

Your Content

You retain ownership of the product images you upload. By uploading content, you grant us a limited license to process, store, and transform your images solely for the purpose of providing the Service.

Generated Images

You own the images generated by the Service using your uploaded content and credits. You may use generated images for any lawful commercial purpose, including product listings on Amazon, Shopify, and other ecommerce platforms.

Our Intellectual Property

The Service, including its AI models, algorithms, software, design, and branding, is owned by SellBig and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand assets.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

7. Limitation of Liability

To the maximum extent permitted by law, SellBig shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to SellBig in the 12 months preceding the claim.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that generated images will meet your specific requirements or achieve any particular sales results.

9. Indemnification

You agree to indemnify, defend, and hold harmless SellBig and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service or violation of these Terms.

10. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. Unused credits may be forfeited upon termination for cause.

11. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the revised Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SellBig operates, without regard to conflict of law principles.
